Terms of Use
The following Terms of Use outline your obligations when using the InTech website. You can also review our Privacy Policy, which outlines our obligations and practices in handling any personal information that you may provide us with.
1. Acceptance of Terms
These Terms of Use are a contract between you and InTech d.o.o. ("InTech"), a company whose registered office is located at Janeza Trdine 9, 51000 Rijeka, Croatia. InTech operates through the website www.intechweb.org ("InTech website", “this website”), through which it provides barrier-free Open Access scientific literature. By using the InTech website and any service accessible from the InTech website, you are agreeing to be bound by the following terms and conditions ("Terms of Use"). If you do not agree to these Terms of Use, please do not access or use the services or the content on InTech website.
2. Modifications of Terms of Use
InTech may change these Terms of Use any time and so you shall be responsible for checking these terms regularly. Your continued use of the InTech website will be deemed acceptance of the updated or amended terms. If you do not agree to the changes, you should cease using this website.
3. Content Ownership
Unless otherwise indicated, the contents of www.intechweb.org are the property of InTech d.o.o. The copyright of the material contained on this site belongs to InTech or its licensers. You acknowledge and agree that the InTech website, and any necessary software used in connection with the InTech website, may contain proprietary and confidential information that is protected by applicable laws governing intellectual property, proprietary rights and the like. All InTech website code and specifications are subject to their explicit or implied licenses.
All publications published by InTech on the InTech website, unless otherwise indicated, are licensed by the respective authors of such articles for use and distribution by you, subject to citation of the original source in accordance with our Copyright policy.
With the exception of InTech's publications, you may not redistribute any of the Content on the InTech website or create a database in electronic form or manually by downloading and storing any such content without InTech's prior written authorization.
4. Trademarks
InTech, InTechOpen, and other InTech graphics, logos, designs, page headers, button icons, scripts, and service names are registered trademarks of InTech in Croatia and/or other countries. InTech's trademarks may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion.
5. Linking
With the exception of InTech's publications, you may link to, but not replicate, the Content on the InTech websites provided (i) you do not create a frame or any other bordered environment around the content, (ii) that any such linking does not imply any endorsement of any product or services, and (iii) that the website linking to the InTech website does not contain any intellectual property rights (including without limitation copyright, trademark, design right or patent, infringing, distasteful or offensive material).
InTech reserves the right to require you to remove any link to this website from a website that is considered inappropriate, offensive or distasteful.
Additionally, the InTech website or relevant third parties, may provide links to other websites or resources. Because InTech has no control over such sites and resources, you acknowledge and agree that InTech is not responsible for the availability of such external sites or resources; it does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. Your business dealings with any third parties through the InTech website (including payment and delivery of related goods or services and any other terms, conditions, warranties or representations associated with such dealings), are solely between you and such third party. You further acknowledge and agree that InTech shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
6. Your Account
In order to open an "Account" on the InTech website and submit articles for publication on the InTech website, you must (i) agree to these Terms of Use, (ii) agree to the InTech Publication Rights Agreement and (iii) provide any information required by InTech during the registration process.
You are responsible for maintaining the accuracy of this information and the security of your Account and password. InTech rejects liability for any loss or damage from your failure to comply with this security obligation. You bear responsibility for all content that you post on the InTech website and activity relating to your Account (including content posted by others under your Account).
You shall: (i) notify InTech immediately of any unauthorized use of any password or Account or any other known or suspected breach of security; and (ii) report to InTech immediately and use reasonable efforts to stop immediately any unauthorized activity you are aware of or suspect.
InTech reserves the right to limit, suspend or terminate your access and use of the InTech website at any time without notice.
7. User Conduct
As a condition of your use of the InTech Sites, you agree not to:
- Upload, post, email, transmit or otherwise make available any information, materials or other content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, pornographic, or offensive; or that infringes another's rights, including any intellectual property rights
- Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity; or obtain, collect, store or modify personal information about other users
- Upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation
- Modify, adapt or hack the InTech Sites or falsely imply that some other site is associated with the InTech Sites or InTech; or
- Use the InTech Sites for any illegal or unauthorized purpose. You must not, in the use of the InTech Sites, violate any laws in your jurisdiction (including but not limited to copyright laws).
In the course of using the InTech Sites, you may provide InTech with feedback, including but not limited to suggestions, observations, errors, problems and defects regarding the InTech website ("Feedback"). You hereby grant InTech a worldwide, irrevocable, perpetual, royalty-free, transferable and sub-licensable, non-exclusive right to use, copy, modify, distribute, display, perform, create derivative works from and otherwise exploit all such Feedback. You agree that InTech has no obligation to pre-screen or monitor your access to or use of the InTech website or any content provided or made available through the InTech website, but has the right to do so. You agree that InTech may remove or delete any entries, information, materials or other content violating these Terms of Use or otherwise objectionable.
8. Disclaimer of Warranties
YOUR USE OF THE INTECH WEBSITE OR ANY WEBSITE TO WHICH IT IS LINKED IS AT YOUR SOLE RISK. THE INTECH WEBSITE AND ITS CONTENT ARE PROVIDED FOR USE ON AN "AS IS" AND "AS AVAILABLE" BASIS. INTECH MAKES NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO THE INTECH WEBSITE OR ITS CONTENTS AND HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT RELATING TO THE INTECH WEBSITE, ITS CONTENT OR ANY WEBSITE TO WHICH IT IS LINKED. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM INTECH OR THROUGH OR FROM THE INTECH WEBSITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS OF USE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, INTECH STRONGLY RECOMMENDS THAT YOU INDEPENDENTLY VERIFY ANY INFORMATION UPON WHICH YOU CHOOSE TO RELY.
9. Indemnity
You agree to indemnify and hold InTech and its subsidiaries, affiliates, officers, agents, co-branders or other partners and employees, harmless from any claim or demand, including reasonable attorney fees, made by any third party due to or arising out of your use of the InTech website, your connection to the InTech website, your violation of these Terms of Use, your violation of any rights of another, or any breach of the foregoing representations, warranties and covenants. The user is solely responsible for his or her actions when using the InTech website, including, but not limited to, costs incurred for Internet access. InTech reserves the right, at our own expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.
10. Limitation of Liability
In no event shall InTech or its employees, agents, suppliers, or contractors be liable for any damages of any nature, including without limitation any consequential loss, loss of income or profit, loss of or damage to property, claims of third parties, or any other loss, cost, claim or expense of any kind or character arising out of or in connection with the use of the InTech website its content or any website with which it is linked. This exclusion and limitation only applies to the extent permitted by law and does not apply to liability for death or personal injury caused by the negligence of InTech, its employees, agents, suppliers or contractors.
11. Termination
InTech reserves the right to change these terms and conditions by posting changes on this page of the InTech website and you will be deemed to have accepted such changes if you use this website after InTech has published the amended terms and conditions on this page of the website.
InTech may terminate or suspend any and all Services and your InTech account without prior notice or liability if you breach any of the terms or conditions of the Terms of Use. Upon termination of your account, your right to use the Services will immediately cease.
These terms shall be governed by and construed in accordance with Croatian Law.
